Your privacy is important to us. This Website Privacy Policy governs our use and disclosure of information collected through our websites and through mobile sites or social media (the “Site”). This Website Privacy Policy explains what information we collect about visitors to the Site, how we use that information, and when that information may be shared or disclosed. It also states how to contact us to ask questions, to access your information, or to request that we update your information.

Using the Site is voluntary, and by accessing or using the Site, you: (i) acknowledge that you have read and understood this Website Privacy Policy; (ii) agree that your access and use of the Site are subject to this Website Privacy Policy (and any related Terms of Use); and (iii) consent to our collection and use of your Non-Personally Identifiable Information and Personally Identifiable Information as described in this Website Privacy Policy, as updated or revised from time to time. Portions of the Site are accessible by the general public; however, access to the CMAPP Platform is restricted to authorized users.

1. Website Privacy Policy Limited to the Site.  This Website Privacy Policy applies only to activities we engage in on the Site and does not apply to activities that are “offline” or unrelated to the Site, including activities occurring on other websites that we may operate.  If you choose to access the Site from locations outside the United States of America, you do so at your own risk and subject to the laws of the United States of America.

2. The Information We Collect and How We Use It.

a. Non-Personally Identifiable Information. We and our service providers will record various types of information about Site visitors that does not reveal the identity of individual visitors, such as Internet Protocol (“IP”) address, network address, web browser, user language, the presence/absence of “flash” plug-ins, screen resolution, connection type, computer or device software and hardware attributes, Internet Service Provider, and the pages a visitor accesses and length of time within the Site. This information may be used to analyze usage of the Site, and to maintain and improve the Site. In general, this information is used internally but we may, from time to time, engage a third party’s software or services to assist us with these analyses. In those limited cases, disclosure of this information to a third-party is necessary; however, the data remains anonymous at all times. We do not link this information to personally identifiable information.

b. Personally Identifiable Information. If you choose to use or interact on the Site – such as by registering, applying for products or services, submitting orders, questionnaires, surveys, or requests for information, or using mobile applications or social media platforms – we will collect the personal information that you (or your personal representative) provide. For example, if you complete a form to ask about our contracted pharmacy network, we will receive the information you enter into the form, including your name and contact details, such as email address and phone number. Information collected when registering for access to the Site may include, without limitation, your name, role (i.e., Pharmacist, Technician, Client, Pharmacy Administrator), employee identification number, date of birth, address, phone number, email address, security questions and answers, company name, job title and licensure information, as applicable.

In all such cases you choose whether to provide us with Personally Identifiable Information; however, certain portions of the Site may not be available to you if you do not provide the information requested. By providing such information, you consent to our collection and use of it, as described in this Website Privacy Policy. By providing an email, fax number or a phone number, including a cell phone number, you consent to our collection and use of the information, such as to send emails, make calls and send faxes to you. We may also use information that you provide to contact you about programs or services offered by us or our clients. We may contact you to see if you are interested in learning more about our programs. If you do not want to receive further marketing communications, you may opt out by following the instructions in the message we sent to you.

c. Information Pertinent to Services Provided through the CMAPP Platform. Certain features of the CMAPP Platform require the use and disclosure of Protected Health Information (“PHI“), as such term is defined by the Health Information Portability and Accountability Act of 1996 and its implementing regulations, as amended from time to time, including by the Health Information Technology for Economic and Clinical Health Act (collectively, “HIPAA“). You acknowledge and agree that the use and disclosure of PHI through the CMAPP is governed by the CMAPP Software License Agreement, and not by this Privacy Policy.

d. Use of Cookies and Other Technology Logging.  We use various technologies to collect certain non-personal information and aggregate information about you to help us analyze and improve the usefulness of our Site.  We may use cookies, web beacons, HTML code and other technology on the Site. We may use these technologies to monitor individual activity in aggregate to improve the Site and provide features that are tailored to your needs. Most web browsers automatically accept cookies, but you can usually change your browser settings to prevent this. If you disable cookies, your ability to use some features of the Site may be limited. We also use tracking cookies to determine what sites you visit when you leave our Site. This information helps us identify content and services that may be of interest to our users as we work to make further improvements to the Site. You may set the privacy options of your browser to block cookies, or to request permission to set a cookie. However, if your browser does not accept cookies, you may be unable to access some of the features of the Site.

3. When Information May be Shared or Disclosed. We do not currently share your personal information with any outside third parties in order for them to market directly to you. However, we may collect, maintain, and use your Non-Personally Identifiable Information and Personally Identifiable Information for the following purposes:

  • helping to establish and verify the identity and eligibility of users;
  • opening, maintaining, administering and servicing users profiles, accounts or memberships (including to confirm Site transactions with you);
  • processing an application or enrollment as requested by you;
  • providing services and support to users, such as delivering web-based products or services, informing you about health or wellness programs you might be interested in provided by us or other businesses, or providing documents or other information you request;
  • marketing our products and services to you;
  • analyzing and improving our products, services, Site, and advertising, including tailoring it to users’ preferences;

  • providing users with company updates or with information about Site functionality;

We limit access to your information to our employees and representatives who need that information in order to fulfill their duties. We do not share your personally identifiable information with other people or companies except in the following situations:

  • We may provide information to companies that perform operational, marketing, or other services relating to the information on our behalf. We limit the information provided to what the companies need to fulfill their duties, and the companies are required to accept confidentiality restrictions establishing that they are not entitled to share the information or to use it for purposes other than providing services to us.
  • We may provide information to our affiliates, such as the National Community Pharmacists Association.
  • We may transfer information if our ownership changes as a result of a merger or acquisition by another company.

At all times, we reserve the right to disclose any information, including personally identifiable information, to comply with any applicable law, regulation, legal process or government request, to protect our rights or our property, or during emergencies when safety is at risk, or for credit fraud protection and risk reduction purposes.

4. Data Storage. Your Non-Personally Identifiable Information and Personally Identifiable Information may be stored in our databases, affiliated company or subsidiary databases, or databases managed by third party service providers, which are located within and outside of the United States. Your information will be automatically transferred to these databases for storage and maintenance. These databases may be located in countries where privacy rules differ and may be less stringent than those of the United States.

5. How We Protect Information. We have implemented technical, physical, and administrative safeguards to protect the privacy and security of information collected from visitors to our Site.  We strive to update those as needed. However, we cannot guarantee the security of any information that is disclosed online and you do so at your own risk.

6. Our Commitment to Children’s Privacy. Our Site is not directed to children, or designed to attract children, and we do not knowingly collect information from anyone who is younger than thirteen.  We request that children under the age of thirteen not submit any personal information to the Site.

7. Links.  Our Site may contain links to sites operated by other companies, organizations, or people. We do not necessarily endorse the content of these websites and are not responsible for the content or privacy practices of these sites, and we encourage you to read the privacy policies posted on the sites before providing personal information through the sites. You should contact these entities directly if you have any questions about their use of the information that they collect.

8. How to Contact Us. You may access your personally identifiable information that has been collected by us. You may also request that we correct or update that information. To protect your privacy, we will take reasonable steps to verify your identity before granting access or making any changes to information.
